Environmental Documentation Requirements for Aquaculture Projects

Mr. Hoang Van Tung’s company, based in Lam Dong, operates in the field of cage aquaculture. The company runs a sturgeon farming facility with 220 cages, supplying approximately 170 tons of fish to the market annually. The total investment is VND 25 billion, and the water surface area used is 44.81 hectares (as per the permit for operating within the safety corridor of a hydropower reservoir).

The facility officially began operations on June 1, 2023. Since that time, there has been no change in its scale, capacity, or area. The company currently employs 9 workers.

The facility generates the following volumes of waste:

Production wastewater: The fish are farmed using a natural cage system on the hydropower lake. Currently, there is no official guideline for calculating the volume of wastewater generated from this activity.

Domestic wastewater: Estimated maximum generation is 0.72 m³/day.

Solid waste from farming activities: Dead fish waste is about 4–5 kg/month. This waste is not discharged into the environment but is collected and composted for fertilizer.

Household solid waste: Recyclable materials such as plastic and cardboard packaging are reused for storing compost or sold to local scrap collectors. Non-recyclable waste is collected and taken to the commune’s central landfill daily. This type of waste is estimated at around 2 kg/day.

Hazardous waste: Primarily includes used engine oil and oil-contaminated cleaning cloths, with an average volume of about 40 kg/year.

Environmental Sensitivity

According to Clause 4, Article 25 of Decree No. 08/2022/NĐ-CP dated January 10, 2022, the facility does not fall under areas deemed environmentally sensitive.

 

Mr. Tung has requested guidance from the relevant authorities regarding the preparation of environmental documentation for his fish farming operation.

 

The Ministry of Natural Resources and Environment (now the Ministry of Agriculture and Environment) responded as follows:

Due to incomplete information—specifically whether the company had already prepared and obtained approval for environmental documentation in accordance with the 2020 Law on Environmental Protection before commencing operations on June 1, 2023—and lacking details about the permit to operate within the safety corridor of the Đồng Nai hydropower reservoir (such as which authority issued it), the Ministry cannot yet provide a detailed response.

Mr. Tung is advised to refer to the following legal provisions for further guidance:

Section 9, Appendix IV of Decree No. 08/2022/NĐ-CP dated January 10, 2022, which provides detailed implementation regulations for the Law on Environmental Protection. This section stipulates that:

“Mineral exploitation projects; projects involving the exploitation and use of water resources that fall under the licensing authority of the provincial People’s Committee are subject to environmental regulations.”

According to Points d and e, Clause 4, Article 28 of the 2020 Law on Environmental Protection, this project falls under Group II investment projects, which pose a risk of adverse environmental impact.

Point b, Clause 1, Article 30 of the same law further states:

“Group II investment projects specified in Points c, d, đ, and e, Clause 4, Article 28 are subject to environmental impact assessment.”
