Enterprises propose to remove obstacles in importing medical equipment

Thien Phuc Medical Equipment and Supplies Trading Service Co., Ltd (HCMC) has a shipment of imported medical equipment that arrived at Cat Lai port on December 30, 2022. However, up to now, the goods have not been gone through customs clearance because of Point d, Clause 2, Article 76 of Decree No. 98/2021/ND-CP dated November 8, 2021 of the Government has expired and there is no decision on extension.

Specifically, at Point d, Clause 2, Article 76 of Decree No. 98/2021/ND-CP stipulates:

For medical equipment that is not on the list of required import permits (except for chemicals, insecticidal and germicidal preparations used in the household and medical fields that have only one purpose of sterilizing the medical equipment) and had a classification as medical equipment of categories C, D announced by the Ministry of Health on the Portal to continue to be imported until the end of December 31, 2022 according to demand, not limited to: quantity without a written certification of being medical equipment from the Ministry of Health when carrying out customs clearance procedures;".

From March 24, 2022, Thien Phuc Medical Equipment and Supplies Trading Co., Ltd. has submitted an application to the Ministry of Health to register the circulation number in accordance with regulations. File number 000.00.04.G18-220324-0013 with receipt number 0001505 dated March 28, 2022, but so far has not been issued.

The company repeatedly contacted the Ministry of Health by mail and phone, but did not receive a direct or written response from the Ministry.

For a newly established business, which is in the early stages of operation, the above problems persisted for a long time, causing difficulties directly for the Company as well as the units being served by the Company for medical supplies.

Through the Government e-commerce portal, Thien Phuc Medical Equipment and Supplies Trading and Services Co., Ltd. requested the competent authorities to soon have a solution to solve this problem.

According to a representative of the Ministry of Health, through inspection and review, the shipment of Thien Phuc Medical Supplies and Trading Co., Ltd. has not been cleared for customs clearance for the reason that Point d Clause 2 Article 76 of The Government's Decree No. 98/2021/ND-CP dated November 8, 2021 has expired and there is no decision to renew it, so it is not valid.

The Ministry of Health has received the application for registration of circulation of Thien Phuc Medical Equipment and Supplies Trading Co., Ltd since March 2022, however, at present, the number of applications for registration number of the circulation number of 2022 received by the Ministry is very large, about 7,000 applications. The Ministry is still urgently processing the pre-submitted documents in order and trying to complete them as soon as possible.

The Ministry of Health has also reported on the difficult situation of organizations and individuals importing, exporting and trading in medical equipment regarding registration and circulation of medical equipment, and drafted in the Decree amending Decree No. Decree No. 98/2021/ND-CP consulted the Government members on the solution, which is to allow an extension of 1 year of validity of the issued licenses until the end of December 31, 2023.
