Specifically, the bidding documents contain the following requirements:

"Contractors must declare detailed information on major constructional equipment that ensure the expected minimum mobilization standards and / or propose facilities and equipment to meet requirements. In order to implement the bidding package in accordance with the provisions of the Circular 11/2016 / TT-BKHDT dated July 26, 2016 on preparing EPC bidding documents; particularly for equipment requiring compulsory registration of special vehicles, the contractor must provide a certificate of special-use vehicle registration enclosed with an inspection certificate is a certified copy; in case of renting, the lessor must have documents proving the ownership of the leased equipment and a lease contract ".

Regarding this issue, The Ministry of Planning and Investment has the following opinion:

According to the Form No. 17 Chapter IV of the Bidding Documents for Design, Supply of Goods and Construction, issued together with the Circular No. 11/2016 / TT-BKHDT dated July 26, 2016 of the Ministry of Planning and Investment The construction equipment must be owned by the contractor or leased but the contractor must prove its mobilization ability to meet the requirements of the bidding package. In case of renting, there must be a contract on equipment lease and documents proving that the equipment belongs to the lessor.

Regarding Mr. Tuan's problems, the evaluation of bids shall comply with the above provisions.

Accordingly, if the main construction equipment proposed by the contractor in the bid (including construction equipment owned by the contractor and the construction equipment employed by the contractor) has the technical features meeting the requirements of the bidding documents and the documents proving that the equipment belongs to the contractor, the lessor as well as the contractor's ability to mobilize the equipment proposed by the contractor are evaluated. is meeting the requirements of the bidding documents regarding the ability to mobilize major construction equipment to perform the bidding package.
