Mrs. Nguyen Kim Ngan (Dong Nai) asked whether foreign workers, who are legal representatives on business certificates, also act as investors on investment licenses, and simultaneously hold the position of general director, are required to sign labor contracts.
Regarding this issue, the Ministry of Labor - Invalids and Social Affairs provides the following response:
Foreign workers who serve as both legal representatives on business certificates and investors on investment licenses, while also holding the position of general director, are considered employers. Therefore, they are not required to sign labor contracts.
