Distance from gas station to intersection

The Nguyen Van An private enterprise plans to build a petrol station, the distance from the gas station to the opposite intersection (on the other side) is 33.5 meters but in QCXDVN 01: 2008 / BXD does not stipulate plan to intersect on the same or the other side.
Through the receiving and responding system to businesses’ recommendations, the company would like to request the relevant authorities to answer, are there any conditions for businesses to build petrol stations?
Regarding this issue, the Ministry of Transport answers this issue as follows:
The determination of the location of petrol stations is implemented in accordance with the provisions of the Circular No. 50/2015 / TT-BGTVT dated September 23, 2015 of the Ministry of Transport guiding a number of articles of Decree No. 11 / 2010 / ND-CP dated February 24, 2010 of the Government regulating the management and protection of road traffic infrastructure and Circular No. 35/2017 / TT-BGTVT dated October 9, 2017 of the Ministry of Communications transport amending and supplementing a number of articles of the Circular No. 50/2015 / TT-BGTVT.
According to the provisions of the two Circulars above, the distance of the petrol station which is proposed to be connected to the national highway must ensure the simultaneous distance to the adjacent connection points and with the adjacent petrol stations, specifically as follows:

Distance to adjacent connection points
For petrol and oil stores located in inner-city and inner-city areas: it is determined according to the urban traffic planning approved by a competent state agency.
For petrol and oil stores located outside the inner city and inner city areas:
- For national highways without a median strip, the distance between adjacent connecting points on the same side along one side of the route is determined according to the planning grade of the national highway section, specifically as follows: For roads of grade I and II not less than 5,000 meters, for roads of grade III not less than 1,500 meters, for roads of grade IV or less not less than 1,000 meters.
- For national highways with a median strip, there is enough land to build as a speed-change (vehicles passing the intersection only turn right), the distance between adjacent connection points along one side of the route is determined according to the planning grade of the route section along the national highway, specifically as follows: for roads of grade I and II not less than 2,000 meters, and roads of grade III or less must not be less than 1,000 meters.
Distance to adjacent petrol stations
For petrol and oil stores located in inner-city and inner-city areas: According to the urban planning approved by a competent state agency.
For petrol stations located outside the inner city or inner city areas: for roads with median strips, There is enough land fund to build speed change lanes (vehicles crossing the intersection only turn right), the distance between the two adjacent petrol stations on the same side along each side of the national highway section must not be less than 6,000 meters; For a route without a median strip, the distance between two adjacent petrol stations along each side of the national highway is not less than 12,000 meters.
In case the petrol station is located outside the inner city or inner city area, adjacent to the inner city or inner city area, the minimum distance between two adjacent petrol stations on the same side shall be applied as prescribed for non-urban areas and is calculated from the nearest petrol station in the inner city or inner city area.
For sections of national highways running along, adjacent to railroads, rivers, streams and deep pools, the minimum distance between two adjacent petrol stations shall be applied as prescribed for routes with median strips.
For petrol stations that are planned in the vicinity or coincide with the connection points of other branch roads, must be adjusted so that only one connection point exists at that location in the direction of priority or general use.
Based on the above provisions, the private enterprise Nguyen Van An is requested to compare with the expected location to build the petrol station of their unit, in case of response, request the enterprise to send a written request to the Department of Transport of Soc Trang Province so that the Department will advise the People's Committee of Soc Trang Province to send a document to the Ministry of Transport according to regulations.
