In August 2018, Mr. Tho was transferred to the Social Work Center under the Department of Labor - Invalids and Social Affairs, assigned as a social work staff member in the Social Work and Community Development Division until now.
Mr. Tho asked if he meets the conditions to retire early (before age) in October 2028. If so, what benefits would he be entitled to?
Regarding this issue, the Social Insurance of Tien Giang province replied as follows:
Based on Mr. Tho's participation in Social Insurance recorded in the Contribution Management Software - Ledger (TST);
Based on Article 4 of Decree No. 135/2020/NĐ-CP dated November 18, 2020, of the Government regulating retirement age: "From January 1, 2021, the normal retirement age for male workers is 60 years and 3 months, and for female workers is 55 years and 4 months; thereafter, it increases by 3 months each year for males until reaching 62 years in 2028, and by 4 months each year for females until reaching 60 years in 2035."
Comparing Mr. Tho's Social Insurance participation history on the software, his age with the provisions in Appendix I issued with Decree No. 135/2020/NĐ-CP, Mr. Tho was born on October 6, 1970, and works under normal labor conditions (not involving heavy or hazardous professions). Therefore, as of October 2028, he has participated in Social Insurance for 35 years and 7 months, just turning 58 years old, so he does not meet the age requirement for retirement benefits according to regulations (men working under normal labor conditions must be 62 years old to qualify for retirement benefits from May 2028 onwards).
If Mr. Tho wishes to retire early (before 58/62 years old), he must meet the criteria of reduced work capacity and be assessed by a Medical Assessment Council with a determination of work capacity reduction of 61% or more to receive a reduced pension (reduced by 2% for each year of early retirement).
Based on current Social Insurance Law and related guidelines, the pension rate for Mr. Tho if calculated at October 2028 = 67% (reduced by 8% for early retirement) multiplied by the average monthly salary base for Social Insurance contributions of the last 5 years before retirement. Additionally, he will be issued a Health Insurance Card and entitled to healthcare benefits under Health Insurance Law, covering 95% of medical examination and treatment costs (only 5% to be paid by him).
