Cases exempt from online bidding

Mr. Bui Quang Huy's company in Ho Chi Minh City is 100% state-owned. Mr. Huy asks whether his company is allowed to nominate contractors for bidding packages within the specified limits under Article 54 of Decree No. 63/2014/ND-CP, or if it must adhere to the provisions of Article 37 of Circular No. 08/2022/TT-BKHDT, which mandate 100% online bidding?

On this matter, the Ministry of Planning and Investment responded as follows:

Under Article 97 Clause 9 of Government Decree No. 24/2024/ND-CP, cases exempt from bidding on the National Bidding System include bidding packages conducted through nomination.

Therefore, bidding packages conducted through nomination do not need to comply with the regulations of the National Bidding System as specified.

In addition, Circular No. 08/2022/TT-BKHDT dated May 31, 2022, issued by the Minister of Planning and Investment, expired on January 1, 2024 (Clause 2 Article 32 of Circular No. 01/2024/TT-BKHDT dated February 15, 2024, issued by the Minister of Planning and Investment).
