The 2024 Land Law only stipulates compensation for damage within the scope of land acquisition or within the safety corridor of construction works where the State does not acquire land.
In 2004, Ms. Hoang Thi Nhu Lien's family (Da Nang) had 884 m2 of land confiscated to implement a road expansion and upgrading project. The family then bought 2 resettlement lots of 200 m2 and built a 3-storey house according to the standards of a type 1 road, completed in 2012.
However, in 2013, the locality changed the planning, built an overpass right in front of Ms. Lien's house, turning the 48 m wide type 1 road into a dead-end road only 7.5 m wide, with a 4 m high retaining wall in front of the house, blocking the entire view, causing difficulties in traffic, business, and affecting the living environment. The land value decreased by more than 60%.
Thus, Ms. Lien's family has suffered two consecutive planning changes, but there is no mechanism to compensate or support for damages arising after the infrastructure planning.
Ms. Lien proposed that competent authorities review, adjust, and supplement regulations to resolve cases affected by changes in infrastructure planning but without land reclamation, causing a sharp decrease in land use value, loss of livelihood, and loss of business ability.
The Department of Land Management, Ministry of Agriculture and Environment responded to this issue as follows:
The 2024 Land Law only stipulates compensation for damages within the scope of land acquisition or within the safety corridor of construction works where the State does not acquire land. For damages outside this scope, there is not enough basis for assessment and calculation to carry out compensation for damages.
