It is not compulsory to change the use purpose of the whole land plot

Mr. Tran Ngoc He (Bac Ninh) has a garden that was granted a certificate of land use rights in 2004. Now he is in the process of converting the land use purpose into residential land.
Mr. He asked, can he convert a part of the garden or does he have to convert all the garden area?
The Ministry of Natural Resources and Environment responded to this issue as follows:
Grounds for change of land use purpose are specified in Article 52 of the 2013 Land Law.
The land law does not stipulate the conversion of a part of the garden area or compulsory conversion of all the garden area, but it must be consistent with the approved local land use master plan.
However, after changing the land use purpose and the remaining area must meet the criteria specified in Clause 1, Article 14a of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government shall detail the implementation of a number of articles of the Land Law (added in Clause 11 Article 1 of the Government's Decree No. 148/2020/ND-CP dated December 18, 2020 amending, supplementing a number of regulations detailing the implementation of the Land Law) and regulations of Bac Ninh province.
